Probate is the process the government uses to ensure that the creditors and beneficiaries are handled properly. Creditors are paid and then the personal representative (executor) is authorized to take whatever action is necessary to transfer property from the decedent to the decedent’s beneficiaries. All of this is done through the probate process.
