Effective February 11, 2018, the Maryland Healthy Working Families Act went into effect. The Act requires that all employers provide sick and safe leave to eligible employees. For employers with 15 or more employees, the Act provides paid sick and safe leave for all full-time, part-time, temporary and seasonal employees who are over the age of 18 and who regularly work 12 hours or more per week. Qualified employees will be eligible to accrue one hour of sick and safe leave for each 30 hours worked, up to 40 hours per calendar year. Accruals for new employees will begin on their first day of employment. Employees may request and be eligible to use sick and safe leave after the completion of up to 106 days of employment. For employers with less than 15 employees, unpaid sick and safe leave is required to be provided at the same rate.
Employers must also notify all employees of their rights under the Act. The Maryland Department of Labor, Licensing and Regulation has made a draft sample employee notice poster (English/Spanish) available for your place of business, which you may access here.
It is time to make sure your sick leave or Paid Time Off (PTO) policies are in compliance with the new law. It is important that policies be brought into compliance with the new law as soon as possible, since failure to comply can result in significant penalties and fines.
