Davis, Agnor, Rapaport & Skalny (DARS) successfully defended a religious institution in litigation alleging failure to prevent and respond to alleged acts of abuse dating back more than 50 years. Following an investigation, our team developed a strategy aimed at early resolution, including removal of the case to federal court.

We successfully obtained dismissal of the initial complaint based on the insufficiency of allegations to establish institutional liability. After the plaintiff filed an amended complaint, we again moved to dismiss, resulting in a final dismissal with prejudice where the court concluded that the allegations, even as supplemented, failed to support a viable claim.

The DARS team was led by Eric W. Gunderson, with assistance from Hannah L. Martinson.
